Terms of Service

1. Acceptance of Terms
Welcome to LullaTale. By downloading, installing, or using the LullaTale mobile application (the "App") or accessing our website at lullatale.app (the "Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Website.
These Terms constitute a legally binding agreement between you and OLLOMS, a company registered in Poland, operating under the brand name LullaTale ("we", "our", or "us"). Please read them carefully before using our services.
2. Description of Service
LullaTale is an AI-powered platform that creates personalized stories for children. The service works as follows:
- A parent or guardian creates an account and sets up a child profile
- Each day, the child completes a short voice or text interview (up to 5 questions) about their day
- Our AI generates a unique, personalized story based on the child's responses, age, and interests
- Stories are available to read and listen to with AI-generated narration
- AI-generated illustrations may accompany stories for a richer experience
- All stories are saved in a personal library for future enjoyment
3. Account Registration
To use LullaTale, you must create an account. We use passwordless email-based authentication: each time you sign in, we send a 6-digit one-time code to your email address. Keeping access to that email mailbox is your responsibility. By registering, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction)
- You are the parent or legal guardian of the child(ren) whose profiles you create, and you provide verifiable parental consent for the processing of your child's data as described in our Privacy Policy
- All information you provide during registration is accurate and complete
- You will keep access to the email mailbox associated with your account secure and you will not share login codes with anyone
- You are responsible for all activities that occur under your account, including your child's use of the App, and for setting an optional 4-digit Parental PIN to lock the in-app Settings screen
You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
4. Subscription & Payment
LullaTale is distributed through the Apple App Store. Apple Inc. is not a party to these Terms and is not responsible for the App or its content. If you subscribe:
Free tier: New accounts can generate up to 3 free stories total before a subscription is required.
Premium plan: The active premium plan is $9.99 per month (or local equivalent set by Apple's pricing matrix) and includes up to 20 personalized stories per calendar month. Unused stories do not roll over.
Billing: Subscriptions are billed through the Apple App Store. All payments are processed by Apple as the merchant of record, in accordance with their terms. We use RevenueCat as our subscription-management provider to validate Apple receipts and to determine your entitlement; RevenueCat does not charge you directly.
Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
Cancellation: You can cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
Refunds: Refund requests are handled by Apple in accordance with their refund policies.
Price changes: We may change subscription pricing. You will be notified in advance, and any price change will take effect at the start of your next billing period.
Apple disclaimer: Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
5. User Content
When using LullaTale, you and your child provide content including voice recordings, text responses to interview questions, and child profile information ("User Content"). Regarding this content:
Purpose limitation: Voice recordings and text inputs are used solely for generating personalized stories. Voice recordings are transcribed and immediately deleted from our servers.
Name anonymization: Your child's real name is replaced with an anonymous token before any data is sent to our AI provider (OpenAI). The real name is restored only on our servers after the AI response is received.
Ownership: You retain ownership of the User Content you provide. By using the service, you grant us a limited license to process your content solely for the purpose of delivering the service.
6. AI-Generated Content
Stories, narrations, and illustrations generated by LullaTale are created using artificial intelligence. Please be aware of the following:
Not human-reviewed: AI-generated stories are not individually reviewed by human editors before delivery.
Age-appropriate intent: Our AI prompts are carefully designed to produce age-appropriate, child-friendly content. However, we cannot guarantee that every generated story will be perfectly suited to your child or free from unexpected content.
No professional advice: Stories are for entertainment and bonding purposes only. They do not constitute educational, psychological, or medical advice.
Parental review: We encourage parents to review stories and report any content they find inappropriate via [email protected].
7. Children's Privacy (COPPA)
LullaTale is committed to protecting children's privacy. Our service is designed for use by parents and legal guardians on behalf of their children.
- Children do not create accounts and do not have direct login credentials; they cannot independently provide personal information
- All child data is entered and managed by a parent or legal guardian, who can review, edit, or permanently delete it from the in-app Settings screen at any time
- We comply with the U.S. Children's Online Privacy Protection Act (COPPA) and applicable international regulations for children's data, including Article 8 GDPR ("GDPR-K")
- By creating an account and adding a child profile, you affirm that you are the parent or legal guardian and you provide verifiable parental consent for us to process your child's data strictly for the purpose of generating personalized stories
- We do not use children's data for advertising, behavioral profiling, cross-context tracking, or any purpose beyond story generation

8. Intellectual Property
Your stories
AI-generated stories created through your use of the service belong to you. You may save, share, print, or use them for personal, non-commercial purposes without restriction.
Our platform
The LullaTale app, website, brand, logo, design system, AI prompts, and underlying technology are the intellectual property of LullaTale and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of our platform.
9. Prohibited Use
You agree not to:
- Use the service for any unlawful purpose or in violation of these Terms
- Share your account credentials with any third party
- Attempt to access other users' accounts or data
- Interfere with or disrupt the service, servers, or networks
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Use the service to generate content that is harmful, abusive, or inappropriate for children
- Use automated tools, bots, or scrapers to access the service
- Resell, redistribute, or commercially exploit any part of the service without our written consent
We reserve the right to suspend or terminate accounts that violate these rules.
10. Termination
By you: You may stop using the service and delete your account at any time from the Settings screen in the App. Account deletion permanently removes all your data, including child profiles, interview sessions, and generated stories.
By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited use, or if we are required to do so by law. We will make reasonable efforts to notify you before termination, except in cases of serious violations.
Data deletion: Upon account termination, all associated data will be permanently deleted. You may also request data deletion at any time by contacting [email protected].
Sections 6, 8, 11, and 12 of these Terms survive termination.
11. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
To the maximum extent permitted by applicable law, LullaTale and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use of or inability to use the service.
Our total aggregate liability for all claims arising from or related to these Terms or the service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty U.S. dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. For EU consumers, mandatory consumer protection laws of your country of residence will continue to apply.
Any disputes arising from or relating to these Terms or the service shall be resolved by the competent courts in Poland. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. We will update the "Effective date" at the top of this page. For material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Your continued use of the service after the new effective date constitutes acceptance of the updated Terms.
